Analysis of the main gaps and contradictions in the normative and legal provision of preschool education in Ukraine

This document is devoted to a comprehensive analysis of the legislative and regulatory framework in the field of pre-school education.

The aim of the study is to identify legal conflicts, regulatory gaps, inconsistencies between regulatory acts, and other factors that may hinder the implementation of state policy on ensuring high-quality and accessible pre-school education.

During the preparation of the document, an analysis of legislation and subordinate regulatory acts was carried out, as well as a series of focus group discussions involving representatives of education authorities, hromadas and heads of pre-school education institutions. International experts were also involved in the work.

The document examines issues relating to the legal regulation of pre-school education institutions, staffing, funding, inclusive education, institutional autonomy, geographical accessibility of educational services, and consistency between legislative and subordinate regulatory acts. Particular attention is paid to the practical aspects of implementing the legislation, excessive bureaucratic burdens, and the need to update certain regulatory mechanisms.

The document was prepared by experts from the Polaris Programme ‘Supporting Multi-Level Governance in Ukraine’ at the request of the Ministry of Education and Science of Ukraine. The findings and recommendations presented may be used to further improve the regulatory framework for pre-school education in Ukraine.
